Acked is operated by Glasstack, LLC ("Acked", "we", "our", or "us").

By accessing our website or using our services, you agree to these Terms.

If you do not agree, do not use Acked.

Organizations and Authorized Users

Acked is used by organizations and by the individual users those organizations authorize.

If you create an organization or subscribe to the Services on behalf of an entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to both you and that entity, and that entity is responsible for the organization's use of the Services.

If you access the Services as an authorized user of an organization, these Terms govern your individual use of the Services. You do not enter into a separate commercial agreement on behalf of your organization unless you are authorized to do so. You agree to comply with your organization's agreement with Acked as well as these Terms.

The Service

Acked provides tools for alert routing, scheduling, notifications, escalation, and acknowledgement tracking.

The service may include websites, APIs, applications, integrations, and related tools.

Early Access and Beta Services

Acked may offer early access, beta, or preview features.

Beta services may:

• Change at any time
• Contain bugs or interruptions
• Be modified or discontinued

We appreciate feedback, but providing feedback does not create any ownership rights in Acked or its products.

Accounts

You are responsible for:

• Providing accurate account information
• Keeping credentials and API keys secure
• Activity that occurs through your account

Notify us if you believe your account or credentials have been compromised.

Acceptable Use

You agree not to:

• Abuse, overload, or disrupt the service
• Attempt unauthorized access to systems or accounts
• Use Acked for spam, harassment, or unlawful activity
• Reverse engineer or misuse the service
• Interfere with other users

We may restrict or suspend access for misuse.

Notifications and Alerts

Acked is designed to improve alert delivery and acknowledgement workflows.

However, no notification system can guarantee delivery in every situation.

You are responsible for configuring appropriate schedules, escalation paths, backups, and operational procedures for your needs.

Third-Party Services

Acked may integrate with third-party services such as monitoring tools, communication platforms, cloud providers, and notification services.

We are not responsible for third-party services, outages, or changes.

Fees and Billing

Some features may require payment.

Pricing, included usage, and plan details will be provided before purchase.

We may change pricing in the future, but changes will not apply retroactively to already-paid periods.

Intellectual Property

Acked, including our software, branding, website, and related materials, is owned by Glasstack, LLC.

You retain ownership of information and content you provide to Acked.

You grant us permission to use submitted information as needed to provide and improve the service.

Data Protection

Our Privacy Policy describes how we collect and use personal information.

If Customer is subject to Applicable Data Protection Laws that require a data processing agreement, the Data Processing Addendum available at https://acked.dev/legal/dpa is incorporated into these Terms by reference.

Availability

We work to provide a reliable service, but Acked is provided "as is" and "as available."

We do not guarantee uninterrupted availability, error-free operation, or that every notification will always be delivered.

Limitation of Liability

To the maximum extent permitted by law, Glasstack, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, including:

• Lost profits
• Lost data
• Business interruption
• Missed notifications or alerts

To the maximum extent permitted by law, the total aggregate liability of Glasstack, LLC arising out of or relating to these Terms or the service will not exceed the amounts you paid to us for the service in the twelve months preceding the event giving rise to the claim, or one hundred US dollars (USD $100) if you have paid us nothing.

Termination

You may stop using Acked at any time.

We may suspend or terminate access if these Terms are violated or if necessary to protect the service.

Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be posted with a new effective date.

Continued use of Acked after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Virginia, and both parties consent to the jurisdiction of those courts.
